The following terms and conditions shall apply to all orders placed with Yen Dental Laboratory Pty Limited (ACN 112 396 513). All terms and conditions are subject to change at any time and will be published on our website at www.yendental.com.
Any orders or instructions received by Yen Dental Laboratory shall be construed as an acceptance of the terms and conditions for the supply of goods [and services] provided by Yen Dental Laboratory. Upon acceptance of these terms and conditions by the customer, the terms and conditions are binding and can only be amended with the written consent of Yen Dental Laboratory.
Definitions
1. These are the terms and conditions of Yen Dental Laboratory Pty Limited (ACN 112 396 513) herein after referred to as ‘YDL’, ‘we’, ‘us’, ‘our’ or ‘it’.
2. The term ‘customer’ refers to the dentist and/or surgery that has submitted a lab order or sent a case for production. Hereinafter, the Dentist or Surgery may be referred to as ‘you’, ‘your’ or ‘customer’.
Case Acceptance
1. Yen Dental Laboratory provides high quality dental laboratory products and services to dental practitioners.
2. Any instruction received from the customer for the supply of goods or services shall constitute acceptance of these terms and conditions.
3. Yen Dental Laboratory reserves the right not to accept an order for goods and services from any new or existing customer.
4. Any restoration must be inserted by a licensed practitioner.
Pricing
1. Prices for goods are stated on our price list, which can be obtained from the Yen Dental Laboratory customer service team.
2. It is your responsibility to check pricing as needed before placing an order with us. For clarification of any of our products or pricing, please contact us before placing an order.
3. Prices are subject to change without notification at the sole discretion of YDL.
4. GST and other taxes shall be added to the price, in accordance with relevant legislation.
Credit Terms and Payment
1. Credit is provided to the customer at the sole discretion of Yen Dental Laboratory and can be withdrawn or have the amount of credit available to you changed at any time.
2. YDL reserves the right to request payment in advance from a customer.
3. Where credit has been provided by YDL, a monthly statement will be provided early in the following month outlining all invoices raised during the month.
4. Invoices are due for payment within 30 days from the end of the month (net 30 EOM).
5. YDL reserves the right to charge administration and interest fees for outstanding balances beyond the due date.
6. YDL reserves the right to hold case work if the customer’s account falls overdue.
7. Payment can be made by cheque or electronic funds transfer.
Product Description
Any descriptions of our products, whether provided verbally or visually, are approximations meant solely for identification. These descriptions do not constitute a part of our contract, and it is your responsibility to ensure that the product you order is suitable for your intended use. YDL will not be liable for any product you order which is unsuitable for its intended use.
Medical Advice
1. Yen Dental Laboratory will provide goods or services to the customer based on the order form provided by the customer, and may from time to time discuss the case with the customer through email, telephone or in person.
2. The customer acknowledges that such discussions, and any representations by YDL, should be used merely as a guide rather than a definitive recommendation to adopt any specific action or treatment. Nothing transmitted in the course of such discussions shall constitute the establishment of a doctor-client-patient relationship between the customer and YDL. Responsibility for the diagnosis of a medical condition, and for the prescription of treatment planning, material use, or medicines, rests solely with the customer.
Warranty
1. Yen Dental Laboratory offers a warranty on all crown and bridge and denture work for any fractures or defects that occurred as a result of the manufacturing process. We provide the following warranties for the following products from the date of the original invoice:
- PFM crowns: 5 years
- Full cast crowns: 5 years
- E.max press crowns: 1 year
- E.max veneers/inlays/onlays: 1 year
- Fully milled 100% zirconia crowns: 8 years
- Layered Zirconia crowns: 8 years on framework; 2 year warranty on layering.
- Acrylic Dentures: 1 year
- Chrome: 1 year
- Flexible Dentures : 1 year
- Occlusal Splints: 6 months
2. The warranty of any product from YDL is subject to the following conditions:
- The damaged product must be returned to YDL for inspection.
- YDL will replace the product to the original specification for any defects that may occur as a result of the manufacturing process.
- Where a replacement product has been provided, it will receive the same warranty as the product it replaced, except where, in the opinion of YDL, the material selected by the customer has a higher than usual chance of fracture or defect. This will be clearly discussed and documented with the client at the time.
- Where YDL agree to replace the product, the new item will be made to the identical specification as the original product. Substitute materials will not be accepted without approval from YDL.
- If the original restoration is returned due to any major faults/defects caused by YDL and the customer decided not to proceed with a new product, YDL will provide a credit or refund where applicable. The customer will need to contact YDL to discuss the issues before making the payment.
Exclusions
The following is not covered under our warranty:
- Cash refunds for any product.
- Costs incurred for the removal or insertion of any product.
- Remakes due to an accident, neglect, abuse, failure of supportive tooth structure or tissue structures, improper adjustments or poor dental hygiene.
- Restorations partially or wholly fabricated by any other laboratory other than YDL.
- This warranty is in lieu of and supersedes all other warranties, whether expressed or implied, and may not be modified by any agent, employee or representative of YDL.
Remake Policy
1. There will be an additional charge for semi or high noble metals used in the remake.
2. If new implant componentry is required for a remake this will incur an additional charge.
3. If YDL deem that the damage of the warranted case has not been caused by the manufacturing process, they have the right to void the warranty.
4. If an account is overdue, YDL will not process the remake until the account is rectified.
5. YDL reserves the right to charge of 50 – 100% of a case value for a remake based on the following factors:
- A remake is requested after the lab deemed the provided case materials incomplete and/ or unsatisfactory and customer elects to proceed with the completion of the case without making any adjustment, refuses a try-in, or does not supply the requested materials.
- A remake is requested due to treatment plan, material or shade change from the original request.
- A remake is requested greater than 30 days from invoice date.
- A remake is requested because the appliance fits the model, but does not fit in the mouth.
- A remake is requested and the original materials or appliance are not returned.
- If a remake is requested and the remake reason is not specified.
Collection and Delivery
1. YDL provides a complimentary pickup and delivery services.
2. The Customer takes responsibility of packaging casework for safe travel to YDL.
3. The Customer takes the responsibility to ensure their premises are accessible and open for couriers or YDL to collect casework.
4. Any costs arising from a collection deemed futile due to casework not being ready to travel or the premises are closed, after a collection request is made will be borne by the customer.
5. YDL is not liable for any damage, delays, or loss of work that occurs during courier transit.
Governing Law
1. These Terms are governed by the laws of Queensland. No action or proceeding may be commenced or maintained in relation to the site, the services or these Terms except in a court of appropriate jurisdiction in the Commonwealth of Australia.
